Acceptance of Terms
By accessing or using DevHarbor ("the Service", "Platform") — including through the DevHarbor website at devharbor.online, any associated mobile application, or any API — you agree to be bound by these Terms and Conditions ("Terms") in their entirety.
If you do not agree with any part of these Terms, you must immediately discontinue use of the Service. Your continued use of the Platform following any updates to these Terms constitutes your acceptance of the revised Terms.
Description of Service
DevHarbor is a cloud-based integrated development environment ("IDE") that provides web developers with tools to write, manage, and preview code directly in a browser or mobile application. The Service includes:
- A browser-based code editor powered by Monaco (VS Code engine)
- MySQL database provisioning, management, and querying tools
- File management including upload, download, and archiving
- Live preview and public project sharing via unique URLs
- FTP / remote project connectivity (Premium plan)
- Personal sandboxed hosting environments for each user's files
The Service is provided on an "as-is" and "as-available" basis. We reserve the right to modify, suspend, or discontinue any feature or aspect of the Service at any time with reasonable notice to users.
User Accounts & Eligibility
To use DevHarbor you must be at least 13 years of age. Users under 18 must have parental or guardian consent. By registering, you confirm that the information you provide is accurate and that you will keep your account credentials secure.
- You are responsible for all activity that occurs under your account
- You must not share your login credentials with any third party
- You must notify us immediately of any unauthorised access to your account
- Each person may maintain only one free account at a time
- Automated account creation (bots) is strictly prohibited
We reserve the right to terminate or suspend accounts that violate these Terms or are inactive for an extended period, subject to our data retention policy.
Data Security & Privacy
We take the security and privacy of your data seriously. DevHarbor implements the following security measures as standard practice:
- Password hashing — all user passwords are hashed using bcrypt with a minimum cost factor of 12. We never store passwords in plain text.
- Encrypted credentials — database passwords and FTP credentials stored on our platform are encrypted at rest using AES-256 encryption.
- Sandboxed file storage — each user's files are stored in an obfuscated, randomly tokenised directory. No user can access another user's files.
- Secure sessions — sessions are managed with rotating tokens and expire automatically after 14 days of inactivity.
- HTTPS only — all data transmission between you and DevHarbor is encrypted using TLS.
- Email verification — new accounts require email verification before access is granted.
We may collect anonymised, aggregated usage data to improve the Service. This data cannot be used to identify individual users. Please refer to our separate Privacy Policy for full details on data collection and processing.
Limitation of Liability
To the maximum extent permitted by applicable law, Elegant Work Group (Pty) Ltd, its directors, employees, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to:
- Loss of data, files, code, or databases stored on the platform
- Loss of revenue, profits, or business opportunities
- Damages resulting from service interruptions or downtime
- Damages caused by your reliance on information or tools provided by the Service
- Costs of procuring substitute services
- Any damages arising from third-party services, integrations, or APIs used within the platform
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain types of damages. In such cases, our liability is limited to the greatest extent permitted by law.
Cyber Security & Third-Party Attacks
While we implement industry-standard security practices and continuously work to protect the integrity of the Service, no system connected to the internet can be guaranteed to be completely immune from cyber threats.
We commit to the following in the event of a security incident:
- We will investigate and respond to confirmed security incidents promptly
- We will notify affected users within a reasonable timeframe if a data breach is confirmed and their personal data is involved
- We will take all reasonable steps to contain, remediate, and prevent recurrence of security incidents
- We will cooperate with relevant authorities as required by South African law, including the POPIA framework
You are responsible for maintaining the security of your own devices, network connections, and credentials used to access DevHarbor. We strongly recommend using strong, unique passwords and enabling any additional security features we make available.
Service Availability & Uptime
We strive to maintain high availability of the Service and perform maintenance outside of peak usage hours wherever possible. However, we do not guarantee uninterrupted access to the Service.
- Planned maintenance windows will be communicated in advance where feasible
- We target a best-effort uptime but do not provide a formal Service Level Agreement (SLA) for Free plan users
- Premium plan users will receive priority support and advance notice of planned downtime
- We are not liable for downtime caused by third-party hosting infrastructure, internet service providers, or force majeure events
We reserve the right to perform emergency maintenance at any time without prior notice if required to maintain security or stability of the platform.
Acceptable Use Policy
By using DevHarbor you agree not to use the Service for any unlawful or prohibited purpose. The following activities are strictly forbidden:
- Hosting, distributing, or executing malware, viruses, ransomware, or any malicious code
- Using the platform to launch attacks against other systems or services
- Attempting to gain unauthorised access to other users' accounts, files, or databases
- Using the Service to store, transmit, or publish illegal content
- Scraping, crawling, or systematically extracting data from the platform without written consent
- Circumventing, disabling, or interfering with security features of the Service
- Using the platform to send spam or unsolicited communications
- Violating any applicable local, national, or international law or regulation
- Impersonating any person or entity, or misrepresenting your affiliation with any person or entity
- Engaging in cryptocurrency mining or any resource-intensive automated processes
Violation of this Acceptable Use Policy may result in immediate account suspension or termination without notice or refund.
Intellectual Property
Your content is yours. You retain full ownership of all code, files, databases, and other content you create, upload, or store on DevHarbor. By using the Service, you grant us a limited, non-exclusive licence to store, process, and display your content solely for the purpose of providing the Service to you.
The DevHarbor platform, including its source code, design, branding, logos, and documentation, is the intellectual property of Elegant Work Group (Pty) Ltd and is protected by applicable copyright and intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the platform without prior written permission.
The DevHarbor name, logo, and associated marks are trademarks of Elegant Work Group (Pty) Ltd. You may not use these marks in any way that could cause confusion or imply endorsement without our written consent.
Payments, Plans & Refunds
DevHarbor offers a free tier and a Premium subscription plan billed monthly at R50 ZAR per month. Payments are processed securely through PayFast. We do not store your payment card details on our servers.
- Subscriptions renew automatically on a monthly basis unless cancelled
- You may cancel your Premium subscription at any time; access continues until the end of the current billing period
- Refunds are considered on a case-by-case basis. Contact us within 7 days of a charge if you believe an error has occurred
- We reserve the right to change pricing with 30 days' advance notice to existing subscribers
- Premium features will be downgraded to Free plan limits upon cancellation or non-payment after a 30-day grace period
Account Termination
Either party may terminate the account relationship at any time. You may delete your account through the platform settings. We may suspend or permanently terminate your account without prior notice if:
- You breach any provision of these Terms
- We are required to do so by law or court order
- Your account is used for illegal, fraudulent, or abusive activity
- Continued provision of the Service to you poses a risk to other users or the platform
Upon account deletion or termination, your files and databases will be queued for permanent deletion within 30 days. This action is irreversible. We strongly recommend downloading a backup of your data before closing your account.
Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make material changes, we will notify registered users by email and display a notice within the platform. The updated Terms will include a revised effective date at the top of this document.
Your continued use of the Service after the effective date of any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the Service and may close your account.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
Before initiating any formal legal proceedings, both parties agree to attempt to resolve disputes in good faith through direct communication for a period of not less than 30 days.
These Terms comply with applicable South African legislation including the Electronic Communications and Transactions Act (ECT Act), the Protection of Personal Information Act (POPIA), and the Consumer Protection Act (CPA) where applicable.
